3. Purposes of processing and legal basis

(i) Manage inquiries, requests for information, complaints, and suggestions you may send through the Company’s channels (e.g., email, information request form, phone, etc.).

The legal basis is the consent you provide by sending requests, suggestions, and complaints through these channels. You may withdraw your consent at any time without affecting the lawfulness of the processing based on consent before its withdrawal. However, this will mean we cannot process your inquiry or request for information.

(ii) Process your registration on the Website (e.g., viewing contracted products, 2FA, payments and charges, sending you a copy of your contract by email, etc.) carried out through the registration form—to allow you to access and use the various products we offer that require registration—and manage the contracting of the Company’s products and services.

The legal basis is the execution of the Terms and Conditions of the IA Lab Website.

(iii) Send you our Newsletter, if you have requested it by entering your email in the specific Newsletter form.

The legal basis is the consent you give by requesting our Newsletter, which you may withdraw at any time without affecting the lawfulness of the processing based on consent before withdrawal. However, this will mean we cannot send you our Newsletter.

(iv) Send you commercial communications by electronic means (e.g., email, SMS) about IA Lab products and services similar to those you have contracted and that may be of interest to you.

The legal basis for processing your personal data is Article 21.2 of Law 34/2002, of July 11, on Information Society Services and Electronic Commerce, which allows the sending of such communications when there is a prior contractual relationship, provided the sender has lawfully obtained the recipient’s contact details and uses them to send commercial communications about its own similar products or services that were initially contracted.

(v) Send you an email if you, for any reason, abandon the purchase process for the IA Lab product and/or service.

The legal basis is the Company’s legitimate interest in obtaining feedback and comments from visitors and potential customers to improve its products and/or services and at the same time offer a more satisfactory user experience.

4. Retention period of personal data

IA Lab will retain your personal data processed for purposes (i) and (iii) until your inquiry is addressed / you unsubscribe from the Newsletter or until you withdraw your consent, at any time, without affecting the lawfulness of processing based on consent prior to its withdrawal; for purposes (iv) and (v) until you exercise your right to object, at any time; and for purpose (ii) until the end of the contractual relationship with IA Lab (if you registered but did not pay for any Company product, your personal data will be deleted after 12 months).

After these periods, your personal data will be kept properly blocked as long as necessary to comply with the legal obligations to which the Company may be subject and to address possible liabilities arising from the processing, and only for the limitation period of such liabilities.

Also, with regard to the documents you may upload to the Platform, they will be retained for as long as the user deems appropriate and can be deleted at any time. Once deleted, the documentation cannot be recovered; however, you will have the option to store it in IA Lab’s cloud, with the Company acting as data processor.

5. Communication of your personal data

5.1. Recipients

IA Lab may communicate your personal data to payment providers (Redsys Servicios de Procesamiento S.L., Bankinter S.A.) for the purpose of processing payments for purchases made on the Platform, with the legal basis being the execution of the Terms and Conditions agreed with the Company. IA Lab may also communicate your personal data, if applicable, to public bodies (e.g., Public Administrations, Courts, Law Enforcement, etc.) to comply with current legal provisions, with the legal basis being the fulfillment of such legal obligations.

Additionally, third-party service providers may access your personal data who, as a result of providing such services, access and process said data on behalf of and for IA Lab, as data processors (Adobe (cloud), Microsoft (document storage and management), OpenAI (AI model), Amazon Web Services (cloud)).

5.2. Transfers of personal data to third countries

No transfers of your personal data outside the European Economic Area are foreseen.

6. Exercise of rights

You can exercise your rights of access, rectification, erasure, objection, restriction of processing, and data portability regarding your personal data, as well as revoke your consent at any time—without affecting the lawfulness of processing based on consent prior to withdrawal—by writing to the following email address: info@text-radar.com

If IA Lab has reasonable doubts about your identity, it may ask you to provide a copy of your ID card, passport, or equivalent identification document.

7. Responsibility

By providing your personal data through electronic channels, you guarantee that you are over 18 years old and that the data provided to IA Lab is true, accurate, complete, and up-to-date. You confirm that you are responsible for the accuracy of the personal data provided and that you will keep this information properly updated so that it reflects your current situation, being liable for false or inaccurate data you may provide, as well as for any direct or indirect damages that may arise.

Also, if you provide IA Lab with personal data relating to third parties, you declare that you have their consent to do so and accept to inform them of the information contained in this Privacy Policy, exempting IA Lab from any responsibility in this regard. However, IA Lab may carry out periodic checks to verify this, adopting the corresponding diligence measures in accordance with personal data protection regulations.
